TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE DECOR MIX FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US, IF ANY, FOR USE OF THE SERVICE DURING THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless The Decor Mix and its owners, contractors, partners, agents, suppliers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or in connection with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit or make available through the Service.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon any termination, your right to use the Service will cease immediately. The provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, limitations of liability, indemnification, and governing-law and dispute-resolution provisions.

16. Governing Law and Venue

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the District of Columbia, United States, without regard to its conflict-of-law principles. You and The Decor Mix agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the state or federal courts located in the District of Columbia, and you consent to the personal jurisdiction and venue of such courts.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17. Dispute Resolution

Before filing any claim, you agree to first contact us at decor@thedecormix.com and attempt to resolve the dispute informally. You and The Decor Mix agree to make good-faith efforts to resolve any dispute for at least thirty (30) days before pursuing formal legal action.

18. Changes to Terms

We may revise these Terms from time to time in our sole discretion. When we make changes, we will update the “Last Updated” date at the top of these Terms and, where appropriate, provide additional notice (such as by posting a prominent notice on the Service). Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.

19. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and The Decor Mix regarding the Service and supersede any prior agreements.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
